Asylum :
It is the protection granted by Spain to people from outside the European Union or stateless persons who are recognized as refugees in accordance with the law and the 1951 Genev.
Refugee Rights in Spain
During the asylum application:
- The asylum seeker receives an official document that proves their legal status (known as the “white sheet” or “red card”).
- The application is communicated to the United Nations High Commissioner for Refugees (UNHCR).
- No return, expulsion, or extradition measures may be carried out while the application is being processed.
- The asylum seeker has the right to access their file at any time.
- They may work after six months from the interview, provided that there has been no negative resolution.
- They are entitled to free legal assistance and an interpreter.
- They can access healthcare.
- They have access to public education on equal Conditions with citizens.
- In case of lack of financial resources, they may benefit from accommodation and social support that ensures a dignified life.
With refugee status or protection:
- A Foreigner Identity Card (TIE) is issued.
- They may obtain a travel document if they do not have a passport.
- They are granted permanent residence and work permits, whether self-employed or employed, renewable every five years.
- They benefit from free legal assistance and translation services.
- They enjoy the right to healthcare.
- They can access social benefits when necessary.
- They may apply for Spanish nationality after five years of legal residence, with consideration of special cases.
Under temporary protection:
- A TIE is issued.
- They obtain a residence and work permit valid for one year, renewable up to a maximum of three years.
- They have the right to free legal assistance.
- They have access to healthcare services.
- They can participate in public education.
- They may receive social support and accommodation if needed.
- They may apply for nationality after completing the required period of legal residence.
On humanitarian grounds:
- A TIE is issued.
- They receive a residence and work permit renewable annually.
- They have the right to free legal assistance.
- They have access to healthcare.
- They can access public education.
- They may benefit from social support and accommodation if they lack resources.
Obligations:
During the asylum or temporary protection process:
- Report any change of address.
- Cooperate with the competent authorities.
- Submit the required documents as soon as possible.
- Comply with fingerprinting, photographing, and personal registration procedures.
- Attend official appointments.
After obtaining protection:
- Respect Spanish law and contribute to public order.
